PITTSBURGH – Bankruptcy Judge Bruce McCullough unraveled a plot between asbestos lawyers and bankruptcy lawyers, saving Travelers Insurance $146 million.

McCullough ruled May 26 that collusion between the Maritime Asbestos Legal Clinic of Detroit and Skinner Engine bankruptcy lawyers at McGuire Woods in Pittsburgh prevented him from confirming a settlement they planned.

The plan would have channeled 20 percent of Travelers payments to Skinner Engine, pumping millions into a business that doesn’t do any business.

Because Skinner Engine wouldn’t collect if its defense succeeded, he wrote, “Debtor is nothing but financially incentivized to sabotage its own defense.”

He wrote that he himself would breach the Travelers policies that Skinner Engine held if he confirmed the plan.

Typically you will not find these firms on the Internet, or in the yellow pages. We will tell you who they are.” The group says, “the best mesothelioma law firms are not typically in your state, or your city, they are specialists, and you want a firm with a proven track record of success. Again. we will tell you who they are.”

As proof of their credibility, the parent group of the Mesothelioma Victims Center, Americas Watchdog, has been featured or quoted in Newsweek Magazine, The Los Angeles Times as “The Good Watchdog”, Good Housekeeping Magazine, Money Magazine, The New York times, Money Magazine, CNN Money, CNN and NPR.

New York, NY (PRWEB) June 7, 2009 — A newly released federal study indicates that deaths from malignant mesothelioma continue to increase, underscoring the ongoing need to control hazardous work-related exposure to asbestos, says a New York personal injury attorney.

“The tragic legacy of asbestos will be with us for many years to come,” said Joseph W. Belluck, a partner at the New York law firm of Belluck & Fox, LLP, which handles asbestos-related injury cases. “Even today, people in certain occupations continue to be exposed.”

The tragic legacy of asbestos will be with us for many years to come
Even today, people in certain occupations continue to be exposed.

The study, published by the National Institute for Occupational Safety and Health, found that 18,068 deaths in the United States were attributable to malignant mesothelioma from 1999 to 2005. The number increased from 2,482 deaths in 1999 to 2,704 in 2005.

Malignant mesothelioma is a rare and often fatal disease caused by exposure to asbestos. Many people receive the diagnosis without realizing that a job they held decades ago could be the cause, said Belluck.

The use of asbestos has declined since the 1970s. But mesothelioma typically develops in people 20 to 40 years after the initial exposure.

The researchers reported that 26 states had mesothelioma death rates higher than the national average of 13.8 deaths per million per year. Six states had annual mesothelioma death rates exceeding 20 deaths per million people. They were Maine, Wyoming, West Virginia, Pennsylvania, New Jersey and Washington.

New York had more than 1,000 people die of mesothelioma from 1999-2005.

About Belluck & Fox, LLP:
Belluck & Fox, LLP is a nationally recognized law firm that represents individuals with asbestos and mesothelioma claims, as well as victims of crime, medical malpractice, motorcycle crashes, lead paint and other serious injuries. The firm has won more than $200 million in compensation for its clients and their families.

Partner Jordan Fox is a well-known asbestos and mesothelioma attorney who has been named to the Best Lawyers in America, New York Magazine’s “The Best Lawyers in the New York Area” and to Super Lawyers. On two separate occasions his verdicts were featured as the National Law Journal’s Largest Verdict of the Year.

Partner Joseph W. Belluck is AV-rated by Martindale-Hubbell and is listed in New York Magazine’s “The Best Lawyers in the New York Area” and in Super Lawyers.

Dallas, TX: The basic problem of the mesothelioma cancer disease is that the disease surfaces after considerable length of time that is after 15 to 30 years from the time asbestos fibers have placed themselves inside the persons body. Such length of time causes distraction. The age, the metal capacity and by that time the mesothelioma victim might have lost contact with many people with whom he used to work. Let alone the owners of the asbestos industry he used to work for.

With the retirement things change and once the victim of mesothelioma cancer is diagnosed with the disease the world around him / her starts to shrink. He needs to contact the right person to collect for the damages the asbestos industry has done to his health. During his quest, the only person who could help him/her is the mesothelioma cancer attorney.

The list of American citizens who have suffered with the after myth of exposure to asbestos is large. Since 1940 over 3 million people in the US have faced exposure to asbestos, forced by the asbestos industry to work unprotected or live in a contaminated environment while the owners, managers of the industry filled the bank accounts.

Mesothelioma cancer attorney, is the person who gets the victim the rightful compensation he/she deserves by filing a lawsuit against the people responsible for inflicting such harm.

The attorneys, after evaluating the past history, job site and work details, the time of onset of the disease and the history of medical diagnoses, advises the victim on the filing the lawsuit to claim the proper compensation that would cover for the losses the mesothelioma patient has suffered.

Getting in touch with the right mesothelioma cancer attorney is the best thing the mesothelioma cancer victim can do to claim compensation for his ill health from the people responsible of inflicting such harm.

“The World Bank’s new guidelines remind us that asbestos is still present in some construction materials,” said Joseph W. The World Bank’s new guidelines remind us that asbestos is still present in some construction materials
And once again we’re reminded of the importance of limiting hazardous exposure to asbestos.

The World Bank, which provides financial aid and technical assistance in more than 100 countries, in May finalized construction guidelines to discourage the use of asbestos in new construction projects.

Health hazards from breathing asbestos dust include asbestosis, a lung scarring disease, and various forms of cancer, including mesothelioma. Mesothelioma often arises 20 to 40 years after the initial exposure to asbestos.

More than 90 percent of asbestos fiber produced today is chrysotile, which is used in construction materials made of asbestos cement, including pipe, water storage tanks and roofing. The largest users are developing countries. More than 40 countries have banned asbestos, but not the United States.

Mesothelioma is a type of cancer that is almost always caused by an exposure to asbestos. Asbestos is a naturally-occurring mineral that was widely used, but is now known to be a potentially fatal carcinogen. The asbestos fiber consists of long, thin fibrous crystals and may be mixed with other substances in order to resist heat, electricity and chemical damage. Due to these characteristics, asbestos was used in many buildings and other structures throughout the 1900s. One estimation is that up to 80 percent of all buildings constructed before 1978 had asbestos within the design.

The cancer that this substance can lead to mesothelioma can be either malignant or benign. The malignant type of mesothelioma is the most hazardous form of asbestos cancer and is deadly in most cases. It affects the tissue known as the mesothelium, which protects the heart, stomach, lungs, and other organs by making a special fluid that allows the organs to move.

So if asbestos is a well known poison, and is no longer used in today’s structures, why would mesothelioma still be relevant today? The buildings that contained asbestos are still in existence and many of them, especially those that were made before the 1970s, are undergoing vast renovations. During the renovation or demolition process, the asbestos fibers are released into the air, and from there can be breathed into the lungs, causing untold damage. With more and more people willing to “do-it-yourself,” people are more apt to conduct their own renovation projects, rather than contracting professionals. Yet exposure to asbestos, even for brief periods, can be very dangerous-especially without proper precautions.

Another reason mesothelioma is still relevant is because of its long latency period. Due to the way it forms, the cancer may not manifest until anywhere between 20 to 50 years after the initial asbestos exposure. Mesothelioma is rare in people under the age of 55; three-fourths of people diagnosed with mesothelioma are over the age of 65. Therefore, people are just now discovering these lung abnormalities, that may stem from exposures that happened in the 1960’s or 1970’s!

As with most cancers, early diagnosis can increase the effectiveness of mesothelioma treatment. However, the symptoms of mesothelioma that do appear early usually mimic those of other ailments-such as emphysema, influenza, or even a common cold. Scientists are scrambling to unlock the technological advances that can help in the detection and treatment of this aggressive cancer, but there’s no way to turn back the clock and prevent exposure that may have happened decades ago.

Even people who did not work directly with asbestos can be at risk for mesothelioma. There have been cases, including a recent landmark lawsuit in Australia, involving caretakers of asbestos workers who contracted the disease simply by repeated secondary exposure to the carcinogen, such as washing contaminated clothes.

While asbestos is no longer widely used or considered a “miracle fiber,” as it was in days gone by, it still lingers in the infrastructures of the past and is still very present in today’s society.

Asbestos.Net is focused on bringing an easy to use and extremely informative website to those searching for information on asbestos and the associated diseases this deadly fiber causes, including lung cancer and mesothelioma. With our informative videos and accurate, oncologist reviewed articles, we trust you will find this to be a true resource.
